The agent’s obligation of confidentiality toward the client According to Section 11 of the Realtors Law,
the client is protected from exposure:
“A property agent or employed by him will not disclose to anyone, without the client’s consent, and knowledge brought to his attention by or on behalf of the client, unless he must disclose it by law.”
The agent must balance this obligation with the objective duty of fairness in which the agent is asked towards the transaction itself.
Practically speaking, the agent will do well to obtain the customer’s approval before publishing any matter that he seems to care about, and even ostensibly, to the knowledge of all parties.
