Relying on Inconsistency

Section 16 of the Sale Law states that: “If the non-conformity was due to facts that the seller knew or should have known about when the contract expired and did not disclose them to the buyer, the buyer is entitled to rely on it.”

Hence the seller of the apartment must declare in detail any essential defect that exists in the apartment, even if the buyer could have discovered the flaw by checking before signing the contract of sale.
