The introduction to the contract, or rather the first part of the contract, will serve as a basis for a contract between the parties and will present the guiding principles for the agreement.
In our counties, it is customary to preface this part with the word ‘Whereas’ – a structure we inherited from British practice.
This structure should not be overemphasized, but it should be known, of course, that this part is integral to the provisions of the contract.
