Building Rights and Common Property

Building rights are rights, or rather property, jointly owned by all owners in the typical house. This is even though it is not part of the common property.

These rights derive from everyone’s ownership of the land, and since the land on which a common house stands belongs jointly to the apartment owners, the building rights on it also belong to them jointly.
Of course, the neighbors in the typical house can give up or transfer to each other their part in the building rights.
