Building Rights – a Contractual or Proprietary Right

The prevailing law today is that ‘building rights’ can be considered a contractual right or an object right. There are a number of tests to decide the matter, according to the legal-factual reality of the right, where the basic test in the question of whether it is a proprietary right is whether the right is valid towards for all. While obligatory rights are valid towards adjacent parties (In personam).
