In the first stage, the claimant must be entitled to a brokerage fee to prove these two:
that a brokerage contract was signed between him and either party to the transaction or both, and he was the “effective factor” in the agreement.
(The content of the term “effective factor” varies according to the type of transaction, its complexity, and the circumstances surrounding it).
In the second stage, whose importance is intensified in cases where there is no written contract between the parties, the number of brokerage fees to which the claimant is entitled must be examined.
