Whether the breach is fundamental or non-fundamental is appropriate about the remedy of cancellation of the contract and is irrelevant to the remedies of enforcement and compensation.
The distinction between a fundamental breach and a non-fundamental breach mainly concerns the procedure that the injured party must take in order to cancel the contract.
In the case of a non-fundamental breach, the injured party is required to give the violator an extension to perform the contract within a reasonable time before canceling the contract, but in the case of a fundamental breach, the injured party may cancel the agreement immediately without granting an extension to the contract.
