The law stipulates the obligation to return “Whoever received a property, service or another benefit (hereinafter the winner) that was not in accordance with his right under the law, from another person (hereinafter the creditor), must return the winnings to the creditor; Pay him the value. ”
A claim on this ground is for the payment of ‘proper rent’.
A claim on this ground is not optimal. It allows the injured party to receive the lowest compensation.
Therefore; a plaintiff will use this ground only when he has no choice, suppose in case the plaintiff has no contract with the defendant, or if the contract is particularly poorly worded.
