Exemption under the Rental Law
There is a provision in section 15 of the Rent Law that allows the tenant to be exempt from paying rent.
The exemption is conditional on complete or almost complete prevention of using the apartment, such as in the event that the apartment is demolished or there is no physical possibility to enter the apartment.
Or for example when due to a breach of contract by the landlord there is no practical possibility for the tenant to use the apartment.
It should be noted that the provisions of section 18 of the Remedies Contracts Act are not necessarily more restrictive than the provisions of section 15 of the Lease Act.
But the conditions in the two sections are different.
In addition, attention should be paid to the other provisions of section 15 of the Lease Act, in case of frustration the landlord may cancel the contract and more.
