It is best to bring evidence that proves harm due to mental anguish.
However, there is no obligation to bring evidence in this matter and the court is empowered to award compensation by way of the global estimate.
The guiding principle is that there may be cases in which the court is convinced that there is damage worthy of compensation and that in the absence of compensation the rights of the injured party will be essentially violated. In these cases, it is not inconceivable that the court will award compensation by way of the global estimate but on the low and safe side.
