Absolute responsibility for the provisions of the Rental Agreement
The rule is that there is an absolute responsibility on each party to comply with the provisions of the lease agreement.
This is the rule and this is how the signatories to the lease should act. Any deviation from the actual performance of the contract constitutes a breach of the contract.
To illustrate this obligation, I will note that in Israel they rejected the doctrine of ‘effective breach’, which means that the tenant thinks he is acting in favor of the landlord in that in violation of the lease he leaves the apartment and replaces an alternative tenant who agrees to pay twice the rent.
The tenant will still be considered as breaking the lease agreement and will be required to pay compensation to the renter for all that this entails.
